Article 1 Purpose

These terms set out the rights, duties and responsibilities between Acard ("Acard") and you when you use the Acard local app, the public site and the web app.

Article 2 Definitions

  1. "Local app": the Acard desktop app installed on your PC and the official builds of the open-source open-notion-acard. Notes and files in the local app are stored on your PC and do not come to Acard unless you turn on the acard.dev connection.
  2. "Public site": the acard.dev introduction pages, downloads, the waitlist and pages users have made public.
  3. "Web app (Acard Cloud)": the web version used by signing in at acard.dev. It is currently for internal testing only and does not accept outside sign-ups; only people with an invite code can enter.
  4. "Content": notes, files and AI-generated results you create.

Article 3 Posting and changing these terms

  1. Acard links these terms from the public site so anyone can read them.
  2. When we change the terms, we post what changes, the effective date and the reason on the site 7 days before the effective date. Changes unfavorable to you are posted 30 days ahead with a side-by-side before-and-after view, and we also email users whose address we have.
  3. Changed terms apply from their effective date.
  4. If you do not agree with the changed terms, you may leave or cancel your waitlist entry before the effective date.

Article 4 Providing and changing the service

  1. Acard provides local app downloads and updates, the public site and the waitlist. The web app is provided only within internal testing.
  2. Acard may fix the service or change features. Important changes unfavorable to you are announced in advance with the same notice periods as Article 3(2).
  3. By default the local app only exchanges an update check with the outside; details are in the Privacy Policy.

Article 5 Interruption and termination

  1. The service may pause for maintenance, outages or reasons at outside providers. We announce this in advance where possible, otherwise afterwards.
  2. If we end the service we announce it 30 days ahead and let you export your data during that time.
  3. If web app data must be moved or reset during the beta, we announce it in advance and let you export before it happens.
  4. You can export your notes at any time as a zip file of Markdown. The local app keeps working on your PC, and its data stays there even if the service ends.

Article 6 Waitlist and accounts

  1. You must be 14 or older to join the waitlist or create an account.
  2. Joining the waitlist takes an email address and the required consents, and does not by itself give you the right to use the web app. Any launch benefit for signing up with your waitlist email follows what the sign-up form says.

Article 7 Leaving and restrictions

  1. You may leave at any time. Ask hello@acard.dev from the email you signed up with and we handle it within 7 days. Waitlist entries can be cancelled the same way.
  2. When you leave we delete your account and the content on Acard's servers. Local app data is on your PC, so Acard does not delete it.
  3. If you breach Article 12, Acard first tells you why and gives you a chance to fix it before restricting your use. In urgent cases, such as ongoing harm to others, we restrict first and tell you right away.

Article 8 How we notify you

We notify you at the email you gave us. Notices for many users at once may be made by posting on the site for at least 7 days, but matters with an important effect on you are also emailed.

Article 9 Privacy

Acard processes only the personal information needed for the service, as described in the Privacy Policy.

Article 10 Acard's duties

  1. Acard does not do what the law or these terms prohibit and works to provide the service reliably.
  2. Acard does not use your content for advertising or sell it to other companies.
  3. We take opinions and complaints at hello@acard.dev and handle them quickly.

Article 11 Accounts and invite codes

  1. You manage your own account and password and do not share them. If you suspect misuse, tell hello@acard.dev right away.
  2. Invite codes are for the person who received them and must not be sold or published.

Article 12 Your duties

You must not:

  1. post or publish anything illegal or anything that infringes someone else's copyright, trademark, portrait rights or reputation;
  2. post or publish someone else's personal information without consent;
  3. impersonate another person or Acard;
  4. spread malware, send spam, overload the service or access systems without permission;
  5. scrape the public site or other users' public pages in bulk by automated means in a way that disrupts the service;
  6. sell or hand over invite codes or accounts.

Article 13 Open source and outside services

  1. Use, modification and distribution of the source code of open-notion-acard follow its license (GNU AGPL-3.0), and for the source code the license takes precedence over these terms.
  2. Third-party components in the local app, such as fonts, follow their own licenses, listed in THIRD_PARTY_NOTICES.md in the public repository.
  3. Plugins, integrations and outside AI services not made by Acard follow their providers' terms, and Acard does not guarantee how they work.

Article 14 Rights to content

  1. You keep the rights to your content.
  2. Where content is stored on Acard's servers, as in the web app, Acard uses it only as far as needed to provide the service (storing, displaying, transmitting, backing up), free of charge, and only while the account exists.
  3. You must hold the rights needed for the content you upload.

Article 15 Public pages and reports

  1. When you make a page public, anyone who knows its address can see it. You can change this at any time, and you are responsible for what you publish.
  2. If you believe a public page infringes rights or breaks the law, send its address and the reason through the "신고하기" (Report) link at the bottom of the page or to hello@acard.dev.
  3. If an infringement report is substantiated, Acard may make the page private as a temporary measure for up to 30 days and will tell both the reporter and the publisher. The publisher may object (Korean Act on Promotion of Information and Communications Network Utilization and Information Protection, Article 44-2).
  4. Copyright reports also follow the procedure in Article 103 of the Korean Copyright Act.

Article 16 AI features

  1. The local app has no AI feature that goes through Acard's servers. What you exchange with an AI tool you connect to the local app is between you and that tool's provider.
  2. AI features in the web app (internal testing) run only when you start them, and the text they need is then sent to the AI model provider.
  3. AI results can be wrong or incomplete; check them before relying on them for important decisions.

Article 17 Liability

  1. Acard is provided as a free beta and as open source, and we do not promise that it fits a particular purpose or is free of errors. You are responsible for backing up local app data. The app makes automatic backup files inside its data folder, but we recommend keeping another backup elsewhere.
  2. Even so, Acard is liable under the law for damage caused by its intent or gross negligence. Nothing in these terms limits liability beyond what the law allows.
  3. If you breach these terms and cause damage to others or to Acard, you are responsible for it.

Article 18 Disputes and governing law

  1. If a dispute arises, please first write to hello@acard.dev. Acard handles complaints quickly.
  2. These terms are governed by the laws of the Republic of Korea, and lawsuits are brought before the court with jurisdiction under the Korean Civil Procedure Act.
